Service terms
Effective date: September 2, 2026.
These terms govern the Design Peach service operated by Vager Media in Texas.
Membership
Design Peach provides asynchronous design production through a recurring monthly membership. A membership covers the subscribing company, its authorized collaborators, an unlimited backlog of in-scope requests, and one active request at a time, including revisions.
Requests and timing
A request becomes ready after the required brief, supplied copy, assets, access, specifications, and approver are available. Most standard requests receive a first draft or meaningful progress within two business days. This is a workflow target, not a promise that every deliverable will be completed in that period. Larger work is divided into sequential stages.
Scope
Included work is limited to the services described on the checkout page and accepted project brief. Website requests include design files unless implementation is separately agreed in writing. Copywriting, strategy, media buying, video, motion, 3D, front-end implementation, custom backend development, emergency turnaround, printing, paid assets, and third-party licenses are excluded unless separately agreed in writing.
Billing, pausing, cancellation, and refunds
Stripe bills the approved recurring amount shown at checkout. Membership remains active through the paid billing period and renews automatically until paused or cancelled. You may request a pause or cancellation anytime by email or through an available billing control. The change takes effect at the next renewal, and no additional month is charged after the request is processed. Your current paid month remains available through its end date.
While paused, billing and design production stop. Design Peach keeps the organization of your existing Asana queue and previously delivered files so you can restart later. A restart begins a new paid billing period at the membership price available at that time. Unused days do not accrue, transfer, or create account credit.
Payments are final and non-refundable except where a refund is required by applicable law. Requesting a pause or cancellation does not refund the current paid billing period.
Feedback and client responsibilities
The client supplies accurate materials, lawful content, timely consolidated feedback, and one authorized approver. Delivery timing pauses while information, access, approval, or feedback is missing. A material change to an accepted brief may be treated as a new request.
Ownership and licenses
After full payment, the client is intended to own approved final custom deliverables identified in the completed request. Design Peach retains its pre-existing tools, processes, reusable know-how, and unused concepts. Fonts, stock, software, and other third-party materials remain subject to their own licenses. The client represents that materials it provides may lawfully be used.
Portfolio use and confidentiality
Client information will be handled with reasonable confidentiality. Portfolio publication requires client permission when work is confidential or not yet public. A separate written confidentiality agreement controls if one is executed.
Warranties and liability
Services are provided with reasonable professional care, but business, advertising, conversion, legal-clearance, and performance outcomes are not guaranteed. To the fullest extent permitted by law, Design Peach and Vager Media are not liable for indirect, incidental, special, consequential, or lost-profit damages. Total liability arising from the service is limited to the fees paid by the client during the three months immediately before the event giving rise to the claim.
Governing law
These terms are governed by Texas law, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in a court with jurisdiction in Texas.
